Copyright and Fair Use for Photography and Art :

Copyright and Fair Use for Photography and Art By Devin Smith & Willis Penton

Question #1 :

Question #1 For Mr. Ryan’s Art class, you were to create a sculpture of a face. One student chose Shrek’s. You want to take a picture of this and include it in the yearbook. Can you?

Answer #1 :

Answer #1 Even though copyright & fair use laws state that it protects all artistic works, you can still take a picture of it because you are not copying or recreating their work, you are just simply taking a picture of it.

Question #2 :

Question #2 You asked FJHS students to contribute pictures that they took of friends at dances, sporting events, etc. can you include this?

Answer #2 :

Answer #2 Yes, but you have to have permission because they took the pictures and it’s their work.

Question #3 :

Question #3 A photographer from the Era Leader took pictures at the football game and include one in the newspaper. Can you scan this picture and use it? Explain.

Answer #3 :

Answer #3 Yes, you can but as long as you have permission. The rule for images is to only use 15 images or 10% but since it is only 1 image, you can’t use 10% so you have to go to the 15 images rule.

Question #4 :

Question #4 At the dance, a professional photographer came and took pictures of couples and groups. You want to scan these pictures and include them. Can you?

Answer #4 :

Answer #4 No, you can only use Professional Photographer’s photographs for personal use, not for public display. Photographer’s own the copyright to all photographs that they take.
