Child Maltreatment Reporting Law :
Child Maltreatment Reporting Law Mandated by law to report.
Can be charged with a misdemeanor for failure to report.
Must report suspected incidences of abuse, neglect, or abandonment.
Protected from false reporting charges by the “good faith” provision.
Required to give name to hotline.
Protective Custody Law :
Protective Custody Law Children can be removed if:
The child has been abused, neglected or abandoned, or is in imminent danger.
The parent has violated a condition of placement.
No parent, legal custodian, or responsible adult relative is immediately known and available to provide supervision and care.
Placement reviewed by court within 24 hours.
Dependency Court :
Dependency Court Dependency courts review:
Case plans for reunification with parents
Termination of parental rights
Adoption of foster children
Transition to independence
Criminal Court :
Criminal Court Only addresses criminal charges and punishments for convictions.
May serve as a victim advocate.
May serve as an expert witness.
Civil Court :
Civil Court Addresses lawsuits against a perpetrator.
Outcomes include large payments to the victim or victim’s family.
Example - lawsuits against the Catholic Church.
