NYS Legal Separation : 

NYS Legal Separation If you and your spouse have mutually agreed to split up, allow DMC to process your legal separation agreement that will mandate the following issues: Custody and care of children under 21 (if any) including health care and child care expenses; How you will split assets, debts, property and dividends from investments. The sale of real estate and how the sale will be split. The non-custodial parent should consider all payments that will be deducted from the sale price (taxes, capital gains, etc.) and if those deductions will come from the sale price before the split or afterwards so that both of you will incur an equal burden of those payments. Both of you must sign and notarize this document. Take the agreement to the County Clerk’s office and file a petition for a Judgment of Separation. The petition costs $210. After one year and as long as you both have complied with the Orders of the Court, you will be allowed a NYS Divorce on the grounds of a Conversion of a Judgment of Separation.

NYS Divorce by Publication If your spouse has left and you don’t know how to contact them to ask for a divorce, or they have refused to give you a divorce – you could be stuck in that marriage for years: If you and your spouse have lived separately for a year or more and you cannot locate him/her, you can file for a Divorce by Publication. The state requires that you make a “diligent effort” to inform your spouse that you are filing for divorce. As a third party and on your behalf, DMC will correspond with these agencies by sending a letter with a copy of the Summons you filed when you purchased the Index No. Responses received from our correspondence will be submitted to the Court as Exhibits. If an address is obtained the services of a Process Server, whose fee is about $75, will be necessary. If no address is obtained, an Order Directing Manner of Service of Summons will be filed. You as the Plaintiff, will have to submit a sworn affidavit verifying that a search of the major Telephone Directories, in the area where you and your spouse resided as husband and wife, has been performed. If the Process Server is unable to serve your spouse, they will sign a notarized affidavit stating the time and dates they attempted to serve them. The Exhibits, along with the notarized affidavits and signed forms will be filed with an Order of Publication. This starts the process for the Divorce by Publication. Once the Court has approved the Order of Publication, the Court will decide if the Summons should be published in a major newspaper.
