I take this to mean that material that is used for purposes of making a profit (i.e. business, advertising) usually means paying a fee or obtaining permission whereas material used for education does not require you to do so. Educational Fair Use : Educational Fair Use Four Factors of Consideration (What lawyers and judges will consider) nature of the use nature of the work used extent of the use economic effect Educational Fair Use : Educational Fair Use Two key questions: Did the unlicensed use “transform” the material taken from the copyrighted work by using it for a different purpose than that of the original, or did it just repeat the work for the same intent and value as the original? Was the material taken appropriate in kind and amount, considering the nature of the copyrighted work and of the use? If the answer to both of these questions is yes, then you will be compliant with Educational Fair Use Educational Fair Use : Educational Fair Use General Points about Principles: These principles apply to all forms of media The principles apply in institutional settings and to non-school-based programs The principles concern the unlicensed fair use of copyrighted materials for education, not the way those materials were acquired The principles are all subject to a “rule of proportionality.” Educational Fair Use : Educational Fair Use Incorporating in your Classroom Example Project: I had each of my students pick a state and then produce a video with pictures representing that state. When choosing photos and music I required them to use Creative Commons to ensure that the pictures were compliant with Educational Fair Use. Educational Fair Use : Educational Fair Use Creative Commons: A website that allows individuals to access and use multi-media material that is licensed so that you know how it can be used in YOUR project.
