WHO AM I TO TELL YOU THIS? Jim Miller, CADC Doing DUI services for 7 years. Treatment/Education of alcohol/substance abuse to thousands of DUI offenders. Hundreds of DUI evaluations for court and Secretary of State hearings. Ongoing education and dialogue with court officials, hearing officers, attorneys, and other counselors offering DUI services.

WHY DO I WANT TO DO THAT???? BECAUSE IT WILL GET IN YOUR WAY AND KEEP YOU FROM GETTING YOUR DRIVER’S LICENSE. YOUR FOCUS MUST BE ON PROVING THREE THINGS TO THE HEARING OFFICER….

WHAT DO I NEED TO PROVE?: 

WHAT DO I NEED TO PROVE? First, realize that at an administrative hearing you are PETITIONING the reinstatement of your driving privileges . This means that the burden of proof is on YOU! You must prove that you can be a safe and responsible driver.

SO WHAT DO I NEED TO PROVE?: 

SO WHAT DO I NEED TO PROVE? You have identified and admitted the nature and extent of your alcohol and/or drug problem. You have taken adequate steps to resolve this problem. You can be a safe and responsible driver in the future.

WHAT DOES THAT MEAN?: 

WHAT DOES THAT MEAN? Nature of the problem ---- what is the problem? Is it that you made an unusual blunder by drinking so much that day? Is it that you regularly drink excessively and have had other negative consequences but continue to drink in excess? Is it that you have lost control of how much you drink and find it hard to stop once you start?

WHAT DOES THAT MEAN?: 

WHAT DOES THAT MEAN? Extent of the Problem ---- how much has this progressed? What is the history of this problem? What other negative consequences or symptoms of the problem have there been? How long has this been going on?

HAS THIS PROBLEM BEEN IDENTIFIED AND RESOLVED?: 

HAS THIS PROBLEM BEEN IDENTIFIED AND RESOLVED? The answer to these questions were the goal of your treatment or education program. If your treatment or education program was successful, you should be able to answer these questions sincerely and forthrightly.

I WOULD LIKE TO HELP YOU! The answers to the above questions are different for every person – no two people are alike. The clues to these answers are in your evaluations and treatment documents and how they relate to the details and facts of your DUI arrest(s). We can figure it out together or you can use my workbook to figure it out yourself.

A guide to creating the chronological history of your drinking and/or drug use that is required by the Secretary of State. An understanding of the symptoms you have experienced and how they can affect the reinstatement of your driving privileges.

DO I NEED A LAWYER?: 

DO I NEED A LAWYER? You are not obliged to have a lawyer and many people do their hearings without the services of a lawyer. However, a lawyer that is experienced in the hearing process and knows what is expected of the petitioner in a hearing can be a valuable resource. Even if you decide to have a lawyer for your hearing, you will find my information and workbook useful in preparing for your hearing.

A GOOD LAWYER WILL….: 

A GOOD LAWYER WILL…. Help you ensure that your documentation is complete and in order. Help you prepare and understand what will take place at the hearing so that you can provide your testimony forthrightly without being intimidated and nervous. Accompany you in the hearing and present your case so that you don’t feel as much pressure and confusion when being questioned. Include in the fee at least three appearances at a hearing in the case of a denial or partial reinstatement.
