A. The Purpose:

A. The Purpose It is about enforcing policies in place at IU. Not to debate homosexuality or private property. But if the treatment of homosexuality, and the use of property and profits are consistent with IU policy. The groups under consideration are IU South Bend, Chick- fil -A and its associates.

Discrimination: Unfair treatment of a person or group on the basis of prejudice To treat differently on the basis of sex or race Prejudice : A partiality that prevents consideration of an issue or situation

D. Interpretation Our Affirmative Action Policy holds that sexual orientation is an unreasonable, and unsupported way to determine treatment of a human being. It is an arbitrary consideration. If as a university our applications included sexual orientation and we denied people admittance based on that, it would not be an arbitrary consideration of homosexuality. That is, it does not matter if they are homosexual or not, it has no effect on their qualification as a student or human being, it is arbitrary.

To Review… E mployees of this university are to remove any aspect of discrimination from University life The definition of discrimination is based on the Affirmative Action Statement IU “Prohibits discrimination based on arbitrary considerations of such characteristics as age, color, disability, ethnicity, gender, gender identity, marital status, national origin, race, religion, sexual orientation , or veteran status.” The affirmative action policy takes the stance that sexual orientation is an arbitrary consideration The vendor code of conduct expects vendors to be familiar with and adhere to these policies and standards. The vendor code also expects that vendors will treat employees equally regarding all aspects of employment including training and forms of compensation. The goals of the affirmative action policy represent intentions for American Society , not just interactions on campus.

It is important to establish that there is little to no separation between Chick- fil -A, the WinShape Foundation, and the Marriage CoMission They are located at the same places, run by the same people, share the same resources, and funded from the same sources. You cannot separate the actions, associations, or funding of one from the other. So if it can be found that any of them condone discrimination, Chick- fil -A qualifies for removal. Also if it can be found that their actions are inconsistent with any of our policies, then they should be removed.

Isn’t designing a curriculum (that serves as training for employees) for one group and not another group exclusionary.

The homosexual employees would not be allowed to apply for WinShape programming. This is discrimination, not just through WinShape but by Chick- fil -A for supporting them Also discrimination because these are incentives and benefits that homosexual employees of Chick- fil -A are given access to. Moreover, they don’t admit them because they can’t be married, it is an existing policy.

Yes Clearly Chick- Fil -A offering incentives to employees to use its retreat services and making those benefits inaccessible to homosexuals (or at least implicitly designed to exclude them by not being designed for them) is a clear demonstration of discrimination based on sexual orientation. According to Wolfson suppliers are not to discriminate in terms of training or opportunity. Especially since employees could be legally married in some states where Chick- Fil -A operates. This is legal, but it is not consistent with IU policy. And money from each Chick- fil -A order goes to support their actions and perspective

Some have said the SPLC is not as good of a resource as the U.S. Justice Department. So in regards to that I found an appropriate Government resource that made recommendations as to Civil Rights groups to be trusted with these issues.

We want to become acceptable ."

T he public outcry and response from the corporate office was enough to have the official Chick- fil -A sponsorship removed.

C . Is it Discrimination? T he corporate office receives a majority of the profits from Franchisees and maintains a lot of control. So they could easily make a rule and stop this from happening Clearly Family Life and the Pennsylvania Family Institute are prominent in espousing certain beliefs about homosexuality, that they have no right to get married, that it is immoral, and a curable condition. T hese views are not consistent with those of Indiana University, and because they try to spread them throughout American culture, something that IU’s Affirmative Action Policy prohibits, it makes them eligible for removal.

So it is likely that WinShape actually chooses who their money is given to when they donate. This turns the NCF into a money middleman of sorts. It just makes it more difficult to track their contributions Furthermore this information was found in the Reviving Marriage in America Report. Which is a reliable source for info on Chick- fil -A since they are supporters of it.

And denying potentially married homosexual employees from using the incentives that Chick- Fil -A has set up for the use of the WinShape Facilities they are directly discriminating against Homosexuals, married and unmarried. This is also a form of employee discrimination because employees don’t get the same benefits of employment as married heterosexual employees. This is direct, targeted discrimination against a group and as such their approved vendor status should be removed for discrimination against potential employees by denying them certain benefits due to sexual orientation.

The CCV is officially associated with two hate groups the Family Research Council, and American Family Association. These groups have the perspective that homosexuality is a disease. CCV is Focus on the Family’s official family policy council in Ohio

D. Associations Cont . CFA ran a program with the National Organization for Marriage’s Ruth Institute. The National Organization for Marriage is also flagged as an anti-gay group. Many of these groups associate with each other and organize political action through out American Society and perpetuate beliefs that spread a discriminatory view of Homosexuality as a curable disease. They spread other inappropriate lies about homosexuality as well.

E. Q and A Does Chick- Fil -A, the WinShape foundation and its associates treat homosexuality as an arbitrary consideration? No, they treat it instead as a changeable condition or disease. One that should be changed. Although interpreting arbitrary may be difficult, whenever someone begins treating someone’s sexual orientation as a disease, the threshold has obviously been crossed (is race a disease, is ethnicity, is gender?) Does Chick- Fil -A Discriminate through its programing through WinShape , and its associates? Yes, WinShape marriage, and the WinShape retreat do not allow homosexual couples, married or not, to take part in its programing. And employees of Chick- fil -A who are not married, or who are homosexuals are unable to attend the retreat services.

E. Q and A Do the profits from Chick- Fil -A Franchisee sales contribute to the continuation of this perspective and Discrimination? Yes, the profits support the WinShape Foundation and other affiliates and partners which create an environment in which homosexuality is to be treated as a correctable condition. And they also contribute to programing that is meant to directly exclude them based on orientation.

E. The solutions… End the sale of Chick- f il -A sandwiches on Wednesdays at the IU South Bend Grille. Begin to take steps to have them removed as a qualified vendor. Create a review board consisting of Faculty, Staff, and Students to investigate vendor eligibility for future qualified vendors, keeping in mind the line of argument establishes in this presentation.

Counter Arguments Is this improper discrimination against Chick- fil -A No, as a University we function like any customer would setting standards of purchase, Chick- fil -A is in violation of a number of those standards. So we should stop purchasing from them. If refraining from purchasing something for an established reason is improper discrimination, then we would have a moral obligation to buy everything. Luckily in a capitalist system we have the freedom to establish our own standards and spend money according to our standards. Policies against discrimination are based on personal characteristics which are things that corporations don’t really have.

E. Counter Arguments Is this religious discrimination? No, religion is something that we do not discriminate against, but we are not arguing that funding should be retracted because of Chick- fil -A’s beliefs, but because of their actions. Because it is the case that by purchasing from Chick- fil -A will send funds to support views about homosexuality that are inconsistent with our own. Condemning an action that appears religiously inspired is not condemnation of the religion itself.

E. Counter Arguments Discrimination based on religion cont. Just because an action is religiously based doesn’t mean that performing it is protected by our non-discrimination policy. You have a right to your beliefs, but you don’t have a right to all the actions that that belief entails. Ex: You have a right to believe that on the first Friday of every month that a human sacrifice should be given, but when that belief becomes action, you become subject to the standards of institutions that say otherwise (the U.S. Government, Indiana University, etc )

E. Counter Argument Why not let the free market decide? Well the market isn’t really free to begin with. It is not as though Chick- fil -A has any solid presence on campus. Having standards of purchase are part of the free market, IU as an institution is responsible for purchasing the Chick- fil -A, and it should maintain its own standards of purchase.

E. Counter Arguments Isn’t use of money a form of free speech? Well I don’t know all the legalese behind this, but apparently political donations are seen as speech more than anything else But if use of money is a form of speech, then I don’t see how our withholding from purchase of Chick- fil -A is a violation of speech. It is our money. And we were never making the case the Chick- fil -A should refrain from doing what it wants with its money. We are making a case about what we should do with our money.
