WHAT IS EB-5 INVESTOR VISA EB-5 Program United States Citizenship and Immigration Services administers the Immigrant Investor Program commonly referred to as “EB-5″ (Employment-Based Immigration: Fifth Preference). Congress created the EB-5 immigrant visa category in 1990 for immigrants seeking to engage in a commercial enterprise that will benefit the US economy and create at least 10 full-time jobs. The minimum required investment is $500,000 if the investment is made in a Targeted Employment Area (TEA) or rural area ($1,000,000 minimum in all other areas). Each State has their own methodology and process to determine TEA’s. Most Regional Center EB-5 projects qualify as being in a TEA.

EB-5 Regional Center Program Congress created the Regional Center program in 1992 making EB-5 investing less burdensome for investors. The Regional Center program differs from the regular EB-5 program in that it does not require that the immigrant investor’s enterprise itself employ 10 US workers. Instead, it is enough if the investment creates 10 or more jobs directly or indirectly. Regional Centers receive Federal designations to use economic impact models to quantify direct, indirect, and induced jobs created by economic activities. An additional added benefit of a Regional Center sponsored project is that investors do not have to participate in the day to day management of the enterprise .

Qualified foreign investors, their spouse, and children under 21 receive conditional green cards after making one EB-5 investment. The Regional Center sponsored enterprise has 2 years after the investor/family arrives to the US to create sufficient jobs. The economic job impact model converts investment expenditures and revenues into full-time equivalent jobs. Rarely is it necessary to count the actual number of employees hired within the new enterprise. At the 2 year anniversary, the Regional Center and investor provide evidence to the US government verifying job creation data. Job creation evidence typically consists of showing proof of expenditures and revenues resulting from the EB-5 investment. The conditions are removed from the green cards once the government agrees that the EB-5 investment created 10 jobs per investor.

File your petition . Your attorney files your application (your family will be dependents on your application). Expected total costs to date are the attorney fees, the $500,000 investment, a $50,000 administrative fee, the filing fee at USCIS and any miscellaneous expenses you’ve incurred in the process (travel, notarizations, etc.). Interview . Once approved, you will be notified and can make an appointment at your country’s US embassy or consulate for an interview. Once approved, they will provide you with documents to present to US immigration upon your arrival in the US. At that point, you become a US permanent resident (Green Card holder ). Confirm your visa responsibilities . Approximately two years after your approval, Reginonal Center will work with your immigration attorney to prove the job creation. There is a second filing, called Form I-829, to accomplish this. Upon review and approval by USCIS, they will replace you’re conditional green card with the permanent green card which only requires renewal (like a passport) every 10 years . Completion of the investment . The investment continues separately and will be repaid per its own terms.

Investment Process Five Basic Steps Capital Investment:  The immigrant Investor invests the minimum capital requirement, usually US $500,000 + an administrative fee. I-526 Petition: The Investor will file an I-526 petition for conditional green card. Included in this petition will be the project’s EB-5 business plan and Economic Impact Report displaying how the investment will create the 10 new jobs in the next two years. I-526 Approval: Assuming the Investor’s I-526 petition is approved, the investor and his/her spouse and unmarried children under age 21 will apply for a green card either through an Adjustment of Status (Form I-485) or consular processing, which will depend on where the Investor lives. Job Creation:  USCIS  requires that the requisite jobs be created within 2.5 years after the approval of the I-526 petition. Removal of Conditions: Between month 21 and month 24 of the approval of the conditional green card, the Investor must file a I-829 petition to remove the conditions which must demonstrate to  USCIS  that the jobs have in fact been created.
