Sleep Pattern When did you go to sleep the night before? How many hours of sleep did you get that night How many hours have you been awake before the DUI/DWI stop? Events Journal

Eating and drinking What did you have for dinner the night before? Did you have any snacks before going to bed? What was the snack? What did you have for breakfast in the morning? What did you have for lunch the day of the arrest? What did you have for dinner the day of the arrest? Did you have any snacks in between meals? What were those snacks? Don’t forget to include what you drank with each meal and in between meals. How much milk, soda, juice, water? Did you drink any alcohol after your arrest? If so, what did you drink and what were the reasons? Events Journal

Document who, what, when and where: Who were you with before the stop? What were you doing before the stop? Was anyone in your vehicle during the stop? Where did you go that day and what did you do at every place that you went? (Write down the exact times of each event) Were there any witnesses at the stop? What are the names of the police officers you dealt with during the stop and at the police station? What was the name of the person who conducted the official breath, blood or urine test at the police station? Is the person who conducted the official test licensed by the state and approved to administer a chemical test? Events Journal

The Arrest What were the Time and Date, and the Location of arrest? What is the badge number and name of the officer that made the arrest? What is the badge number and name of the officer that conducted the field sobriety test? What is the badge number and name of the officer that conducted the horizontal gaze nystagmus test (EYE TEST)? What is the badge number and name of the officer that conducted the chemical test? Document the facts before your arrest. Did you say anything to the police officer(s)? What did the police officer(s) say to you? Events Journal

The Arrest Were any Miranda warnings given to you, such as the right to have an attorney, the right to remain silent, etc.. If the warnings were given to you, what did the police say to you prior to and after the warnings? Did you give a verbal response or otherwise to the warnings given? Were any field sobriety, or coordination tests administered to you ? (stand-on-one leg, heel-to-toe, , finger-to-nose, divided attention, walk-the-line, recitation of the alphabet, picking up coins etc.)? Events Journal

The Arrest If so, what tests were administered?, Where and when were they given, and how do you believe you performed with respect to each of the tests? Did you refuse to take any of these tests?, If so, was anything told to you by the arresting officers concerning the ramifications or consequences of your refusal? What clothing were you wearing when you were arrested? Were you neatly dressed? Was appearance? Did you have any special shoes on? (high heels)? Were you wearing any jewelry? Did your clothes or footwear restrict your movement in any way or make it difficult for you to walk? If so, explain in detail. Events Journal

Rights Advisement Were you advised that you had the right to refuse to submit to the chemical test or tests? Were you told there were any consequences to your refusal? If so, what specifically do you recall being told about the consequences of refusal? Were you advised that you could consult with an attorney prior to submitting to the chemical test or tests? Were you advised that you could have an attorney present while you submitted to questioning, field sobriety tests, or the chemical tests? If so, what do you recall, and what happened? Events Journal

Road and Weather Conditions and Vehicle Describe the street were you driving on (width, lanes of travel, pavement type, traffic signs or signals)? What was the condition of the street (smooth, rough, bumpy)? Describe the traffic conditions (heavy, moderate, light)? Describe the weather conditions (clear, rainy, drizzle, wet, dry)? Medical Conditions Do you have any physical impairments that may cause you to limp or to have difficulties balancing? Do you have any physical ailment or speech impediment that causes you to slur your words or speak with difficulty? Do you have any physical problem/condition that may cause you to have difficulty breathing? If so, please explain. number, VIN serial number, condition , and color of your automobile? Is there any special features of your vehicle ? (automatic transmission, power steering, power breaks)? Are you aware of any mechanical defects? Do you have any trouble controlling/steering it? Medical Conditions Were you seeing a physician at the time of your arrest? If so, for what condition? Were you taking any prescription drugs or medication? If so, what kind of medication, the dosage, the frequency and the reason for taking the medicine. Include all medicine ie . nonprescription medication (cough syrups, antihistamines, aspirin or ibuprofen) or any controlled substances (cocaine, marijuana, barbiturates, amphetamines etc ) Events Journal
