Child Abuse Is A Crime It is a crime to abuse a child, just as it is a crime to not reports suspicions of abuse or neglect.: 

Child Abuse Is A Crime It is a crime to abuse a child, just as it is a crime to not reports suspicions of abuse or neglect. Being in education is not all glory. We are mandated as reporters, but we are not doing this part of the job the way we need to be. It is the law to report, so do your part.

Reporting Is The Law! For the reporter, making a report of suspected child abuse is difficult. There are always nagging doubts about how the person suspected of abusing a child will react, what the outcome will be, and whether or not the report will put the child at greater risk. The best way to minimize the difficulty of reporting is to be fully prepared for the experience. One should feel reasonably comfortable with the reporting requirements and the process that is triggered by making a report. :

One should feel reasonably comfortable with the reporting requirements and the process that is triggered by making a report . The California Child Abuse Reporting Law is found in Penal Code Sections 11165-11174.3. The following is only a partial description of the statute. Mandated reporters should become familiar with the detailed requirements as they are set forth in the Penal Code (P.C .).

Mandated reporters in public positions include: a teacher; an instructional aide, principals, custodians, bus drivers, food service workers as well as any one who comes into contact with children as a part of their job.

I developed a survey to gather data on Mandated Reporting. I wanted to find real results to find out what we are doing and how well we are doing, and if we are well educated in reporting. It was extremely difficult to get educators to take part in this survey, I believe due to the subject matter. I had to approach many of them personally to get the feedback that I needed.:

The survey was designed in two distinctive parts. Part one was the easy questions, while part two were more to the point and harder hitting. Part two had the participant placed in the vulnerable position of having to take responsibility and perhaps explaining their position on not reporting. :

A fraction of the participant would forge ahead and answer all of the survey. This proved to be correct and the data I gathered also proved to be rather troubling. We seems to be under educated, under involved, and apathetic about mandated reporting od child abuse/ neglect.

What We Need to Understand About The World Today. The world is a difficult place to be a child in today. We as educators have a responsibility to educate and look after the students that are in our charge. Mandated reporting being the law makes it absolutely necessary for us to report what we suspect. This is why the survey results that I got were very shocking to me. We are dropping the ball and not doing a great job with reporting. Changes need to be made and we need to look at the final data to see that we are misguided . If we think as reporters we are doing a good job then we are wrong. :

Participants and Setting The participants were people in education at the school that I teach at. They were teachers, Para- educators, Teachers, lunch room staff, bus drivers, and a custodian. I teach at Cottonwood Elementary for San Bernardino County Schools (SBCSS) and I am a special education teacher.:

Data The Data showed that most of the participants knew about reporting but were never trained in it. Out of 80 answered 75 were never trained. Out of 80 of the participants 70 were not interested in being trained in reporting.73 out of 80 participants were aware of their responsibilities as a reporter. 72 out if 80 stated that they have a resource guide for reporting. 65 out of 80 believe their school has a plan in place for reporting.:

The more difficult questions that may make them culpable for not reporting garnered less responses. Only 35 out of 80 participants took part in this section of the survey. When being asked how many times they reported, the35 called 1-4 times but admitted they should have called more often. Those answers were dramatic.. The outcomes were what I suspected but sad to me none the less.

Data The data showed that educators and CPS do not have trust for each other. We seems to have no trust because of a breach of confidence. Educators stated fear of retribution as the main reason for not reporting. The lack of confidence in CPS has been the reason for this fear. Educators feel that CPS has told the suspects who reported.:

Both surveys taken were basically the same , except for a few answers I believe due to staff changes from year one to year two. It became clear through the survey that we do not want to report nor do we want the responsibility. We also do not want to be educated about reporting. It was also clear that we are not doing a good enough job with reporting, and our attitudes toward reporting is not as it should be.

Looking At The Results: 

Looking At The Results In looking at the results it was also clear that we have to look into a formal training for all mandated reporters. We could and should do this with all of the new hires and have an in-service periodically to keep the certification current, much as we do with CPR. This should be a mandatory certification because , educators do not understand the law. They do not report as often as they should. There is a lack of trust between agencies. We see reporting as someone else's responsibility.

We need to look at the big picture in education and begin to ask the hard questions. What is are real responsibility? It seems that we have become desensitized to abuse, and this troubles me. :

Another implication is that one day we will all know a child or hear about a child that has been killed due to abuse. This has already happen to me at the school that I am at. A child died at the hands of his step father. Someone had to see some changes and notice something was wrong, but no report was made.

Recommendations We need to keep children safe. To do this we need certification, laws to be enforced and we need to work overtime at changing attitudes. We do need to reconsider our place in all of this. As professionals we need to build a strong and trustful bond with other agencies. Nurturing a relationship with other agencies will be the best think to accomplish first. :

Limitations There are certain limitations to the proposal of certification for mandated reporting. First we as educators are not interested in being educated in this area. We have so many difficulties today with the economy that money will most likely not be available. It may be hard to get certification on the books as a law because we actually believe that we are doing a great job with reporting. :

Summary Some people are not mandated as reporters, but many of us are. Those of us who are mandated do have immunity from criminal or civil liability. There are safeguards in place to protect the reporting party. Failure to report can cause a reporter to be fined or jailed or both. :
