Communication : 

Communication It is crucial that we use electronic communications. That is email and mobile telephone SMS messages. You will provide your mobile telephone number – you can also use the number of a family member or friend. You must have an email address; you can get an email address free from Hotmail or Googlemail. Every time that we want to communicate with you we will send an email and a SMS message – go to a computer and log in. If you insist on telephoning YOU will PAY for the call and the time spent on it. With potentially 800,000 claimants, costs need to be reduced. Communications will ONLY be by: e-Mail SMS Messages ONLY http://lloydsactionnow.com/

Methodology : 

Methodology Phase One: Investigation, Documentation and Representation Participants pay a joining fee, enabling Lloyds Action Now to investigate the facts and obtain documentation and make representations on behalf of LAN shareholders; Causes of action to be identified and participants categorised accordingly.   Phase Two: Disclosure and Litigation on merits Disclosure to be sought; Participants may pay an additional fee to fund litigation (own costs and adverse costs insurance); Test cases to be taken to court. Phase Three: Compensation Compensation to be sought for participants who comply with cause of action criteria Participants may pay a final fee for quantification of their compensation.

Management of Group funds : 

Management of Group funds Payments will be received in trust and held by the solicitors in the client account. Fees will be paid by the solicitors on an agreed invoice basis. Solicitors will receive all compensation and costs awards against the defendants into the client account. Solicitors will settle costs obligations of Lloyds Action Now It is likely that if successful, costs will be awarded against the defendants and participants may recover contributions as well as damages. The solicitors will pay the participants.

The methodology of the handling of the case There is no narration to this page please read it. It is very important that, before you decide whether to participate in the case or not, you understand how it will be conducted, what it will cost and what options are available. FIRST it is important to understand and accept that, while LAN has agreements with suppliers which will have to be honoured, the decisions in the case will be taken by participants through the committee elected from the participants. SECOND the case will be handled in three phases. In the first phase, for which a fee of £199 plus VAT is required from every participant, the facts will be gathered, documents obtained and an opinion sought as to causes of action which are likely to succeed; it may be that no such cause of action emerges. In the second phase the causes of action will be litigated. In the third phase compensation will be quantified. Of course, if a settlement can be achieved, this course may change. THIRD the committee will decide on how you will have to fund the case after the First Phase – there are options. Included in the documents that you must print sign and return to us is a document which deals with the above in detail – you must read and sign this, indicating your understanding and acceptance of what is recorded

Payments : 

More participants Payments Join now! £199 – Initial contribution If many shareholders participate, a small top up payment according to number of shares held may be sufficient to pay for all stages of the case if only a few join we may have to ask for a higher further contribution at each stage = = Less each one will have to pay It is highly likely, if the action is successful, that you will get your contribution back, IN ADDITION TO THE COMPENSATION DUE TO YOU. It will not be possible for members to sit on the fence to await a positive outcome. If a shareholder does not participate in the case he will not participate in the success. Litigation funds need to meet own and adverse costs including litigation risk insurance premiums.

Cost : 

Cost Fees have been staggered and kept as low as possible. We would hope to recover most, if not all your contributions by way of costs awards – you would be reimbursed what you have paid. Number of participants is not yet known, however, if a large number joins, the costs will be lower. Late joiners will pay considerably more, but at a point in time will be locked out of participation. Beware of organisations which suggest you can pay a small donation to get redress. Bear in mind that you could become jointly and severally liable for very large costs bills. The defendants will exploit this situation to your detriment.

Insurance : 

Insurance Lloyds Action Now accepts that no participants will want to be or should ever individually be exposed to costs risks. The defendants will conduct ‘cheque-book’ defences and adopt bullying tactics. Lloyds Action Now will ensure there is either sufficient money in the bank accounts of the company to meet all and any costs liabilities; and/or will take out insurance to cover costs risks. All decisions will be made by the committee/director board – compromised solely of Lloyds TSB shareholders who suffered losses. The committee will be made up of participants who will be elected to serve. Participants will elect the committee.

Solicitors : 

Solicitors Highly regarded solicitors, Winckworth Sherwood, have been retained. Winckworth Sherwood have already instructed barristers including Queen’s Counsel Lloyds Action Now is Winckworth Sherwood’s only client. Through its committee, Lloyds Action Now will give instructions to the solicitors. Lloyds Action Now will liaise with participants. IN ORDER TO KEEP COSTS DOWN PARTICIPANTS MUST NOT COMMUNICATE WITH WINCKWORTH SHERWOOD – ALL COMMUNICATION IS WITH THE COMMITTEE OF LAN

eSystems eSystems, a company with IT, litigation and management expertise has created a bespoke and copyrighted system for conducting this case. eSystems will do the documentation, verification, administration, management and clerical work for the case. eSystems will defer the payment of some of the costs due to it, until the end of the case.
