Premium member Presentation Transcript Preparation of Investigation Report : Preparation of Investigation Report Workshop of National Level Monitors on NREGA Nature and Scope of Investigation Report : Nature and Scope of Investigation Report Cause of Action Parties Pleadings Examination of Evidences Inspections Hearing of parties and witnesses Findings – Allegations are true, false, partly true, or no clue, or baseless and motivated Conclusion as to the guilt of the Parties Overall assessment of performance of the District, Block and Gram Panchayat Recommendations for Action to be taken by the Ministry of Rural Development, Government of India Cause of Action : Cause of Action Description of facts and circumstances leading to the case at hand Parties : Parties Give description of the Complainant(s) Defendants – persons against whom the complaint is made Pleadings : Pleadings Complaint(s) : Allegations made must be specific and verifiable, not vague. They must contain specific details of wrongs committed. Defence : Rebuttal of allegations should be made by the persons against whom allegations have been made. Examination of Evidences : Examination of Evidences Both pleadings of the complainant(s) and the defendant should be supported by evidences : oral (of witnesses) or documentary. The evidences adduced by parties should be examined by NLMs by proper verification of authenticity of documents and witnesses. Statements of witnesses should be reduced in writing, read out to them and signed by witnesses. Documents should be verified with the help of the author of the documents or others acquainted with the documents and their authors. Failure to produce evidences by either party should be clearly recorded along with reasons for withholding the evidences. Inspections : Inspections Spot inspections of worksites, offices, or any other place may be made and a memorandum of inspection be made noting the object and findings of the inspection. Hearing of Parties and Witnesses : Hearing of Parties and Witnesses Date of investigation may be intimated in advance to the parties and witnesses so that they have adequate opportunity to make submissions. Parties and witnesses should be heard and their statements reduced in writing and signed by them. Findings : Findings Findings may be recorded allegation wise whether they are true, false or partly true. Clear and elaborate reasons for the findings may be given. Actions or inactions which are alleged to be mala fide, unfair and unjust, in bad faith, or negligent may be clearly established to be so. Irregularities without mala fide or malice may be stated to be so with reasons. Conclusion :Guilt of the Parties : Conclusion :Guilt of the Parties The Report must contain one or two concluding paragraphs containing the gist of the findings and the persons responsible for the wrongs detected Summary Table : Summary Table Summary Table of Investigation containing Sl.No., Brief Statement of Allegations, Evidences Produced, Evidences not produced, Findings (True, False, Partly True, No Clue) with reasons against each allegation. Overall Assessment : Overall Assessment The report should contain an overall assessment of the performance under NREGA of the District / Block / Gram Panchayat by making an analysis of land, water, forest and labour resources available in the District. SWOT Analysis of the Programme in the District / Block / GP: Strength and Weaknesses. Opportunities and Threats Suggestions may be provided to exploit the Strengths and opportunities, remove the weaknesses and avoid the threats. Recommendations : Recommendations Report should state the steps that may be taken by the Ministry or the State Government or other authorities to improve the programme. Format of Report : Format of Report Use Arial Font – size 14 and 1.5 line spacing Chapters for each Head Paragraphs in each Chapter should be consecutively numbered.
