The Idaho Settlement Agreement (ISA) Establishes Requirements The Idaho Settlement Agreement (ISA) between the United States Navy, Department of Energy (DOE), and the INEEL Requires the Idaho National Engineering and Environmental Laboratory (INEEL) is cleaned up and is not a long-term SNL or HLW storage site Allows the shipment of SNF to the INEEL if certain conditions are met Sets limits for the receipt of SNF at the INEEL Sets milestones for removal of the waste and SNF from the INEEL.

Limitations for SNF Receipts Set Forth by the ISA After December 31, 2000, DOE may transport no more than a total of 55 metric tons heavy metal (MTHM) of DOE SNF to the INEEL. Up to twenty DOE (non-naval) truck shipments are permitted each year starting January 1, 2001. DOE may not make more than thirteen DOE truck shipments per year to the INEEL during years 2004-2012. DOE must remove all spent fuel, including naval and TMI SNF, from Idaho by January 1, 2035. Note: The ISA provides the allowance that shipments that DOE is entitled to make to the INEEL in any calendar year, but has not made, may be shipped in any subsequent calendar year, notwithstanding the limitations on the number of shipments per year.

Restructuring of the INEEL The Idaho National Laboratory (INL) will contain the laboratory and R&D functions of the INEEL and the Argonne National Laboratory West (ANL-W). INL will be a DOE-Nuclear Energy (DOE-NE) entity INL will be DOE-NE’s first national laboratory The Idaho Completion Project (ICP) Will be responsible for the remediation and cleanup of the INEEL (non-INL facilities) Will be responsible for the receipt of SNF and the storage, packaging, and shipment of SNF and HLW to the repository ICP will be a DOE-Environmental Management (DOE-EM) entity

INEEL Ultrasonic Inspection Capabilities The INEEL has developed and implemented ultrasonic (UT) inspection of SNF cans with the capability to determine if water has penetrated the can. The INEEL UT inspection method performed better than the required (95% confidence for a 97% accuracy) for the Fermi driver can transfer activity with 100 of 100 calibration cans correctly and accurately inspected. To test the UT system 36 Fermi driver fuel cans were inspected. One can had a small quantity of water In January 2005, 214 Fermi driver SNF fuel cans will be inspected to determine if they are wet prior to placing in dry storage

Major Lessons Learned Early communication and early and complete fuel data is vital. Notify DOE-Idaho Operations Office (NE-ID) as early as possible of the intent to ship No later that eighteen months prior to shipment. Receive NE-ID approval to ship as early as possible No later that twelve months prior to shipment. Provide a complete draft of the Fuel Required Shipper’s Data form as early as possible No later that six months prior to shipment. Determination of the fuel condition and integrity of cladding should be done at least six months prior to shipment
